Air Canada says workers returning to work

Air Canada said its groundcrew employees in both Toronto and Montreal were returning to work Friday morning after a wildcat work stoppage that led to dozens of flight delays and cancellations.

Airline spokeswoman Isabelle Arthur told Postmedia News in an email that an arbitrator had issued an injunction, bringing an end to the job action.

Bill Trbovich, spokesman for the International Association of Machinists and Aerospace Workers (IAMAW), said the parties agreed to end the action on the condition the striking workers would not receive any penalties or fines, and the three suspended employees and 37 Air Canada staff that were subsequently fired afterward are reinstated immediately.

At about 10 p.m. local time Thursday, about 150 ground crew workers walked off the job in Toronto. By Friday morning, the labour action had spread to Montreal.

Air Canada employees at the Quebec City airport also went back to work after having walked of the job earlier Friday to support their colleagues.

Quebec City airport authority spokesman said flights were slowly resuming.

No Air Canada flights landed on the Quebec City tarmac nor left the airport between 8 and 10:30 a.m. local time Friday.

The job action came after the federal government moved earlier this month to prevent a work stoppage at the country's biggest airline, passing legislation to block legal strikes or lockouts.

But on Friday, the travel disruptions apparently feared by the government were taking place nonetheless.

Air Canada spokesman Peter Fitzpatrick said Friday that the wildcat action had a "significant impact" on the airline's operations in the affected cities.

"We are doing everything we can to get our operation back to normal," Fitzpatrick said.

"We'll see if the protesting employees respect (the injunction)."

He said Air Canada passengers should check ahead on their status of their flight and said any flights that were cancelled can be re-booked at no cost.

"We really appreciate how important it is to our customers that they get to travel on time when they want to," he said. "This is obviously very frustrating for them."

At least 60 Air Canada flights out of Toronto's Pearson International Airport, and 30 out of Montreal's Pierre Elliott Trudeau, had been cancelled or delayed, according to the airports' websites.

Steve Kent, the chief commissioner of Scouts Canada, said he, his wife and infant son were trying to get to Houston from Newfoundland, but had to turn back after an ordeal that left his family stranded in Toronto overnight.

"Two delays last night, eventually made it to Toronto, sat on runway, then no bags," he said in an email to Postmedia News. "Two hours sleep.

Added another user: "Keep it up, unionfolk. You'll destroy your own protection walls eventually."

Peel Regional Police in Ontario got a call about the strike Thursday night and arrived to find about 150 workers gathered at the Pearson airport, said Const. Fiona Thivierge.

The workers were "mostly milling about," she said, noting that it was a peaceful demonstration that had already started to disperse.

"It looks more impromptu than anything else," Thivierge said.

"They're yelling and chanting and stuff, but there are no signs and they're not disrupting the flow, which is what we were most concerned with."

Management was on scene, Thivierge said.

On March 13, legislation passed the House of Commons preventing the airline from locking out pilots and blocking any legal strikes from members of its machinists union. Bill C-33, which passed by a vote of 155-124, addresses about 8,600 mechanics, baggage handlers and other ground crew, along with about 3,000 pilots.

The bill passed the Senate two days later.

Last Sunday, Air Canada said it had asked the government's labour relations board to intervene after an unusually large number of pilots called in sick on a busy spring-break weekend, contributing to numerous flight cancellations.

At that time, Queen's University industrial relations professor George C.B. Smith told Postmedia News the disruptions come as no surprise, given the government's imposition of a resolution.

"There's a huge trust that traditionally exists between employers and employees and when that trust is broken, this is one of the potential outcomes."

Smith, a former director of employee relations for Air Canada, told Postmedia News, "This is the part that (Labour Minister Lisa) Raitt doesn't understand. ScienceDaily (Mar. 20, 2012) ? Parents who feel guilty about letting their young children watch too many fantasy movies on TV can relax.

Researchers from Lancaster University have discovered that youngsters who watch films like Harry Potter improve their imagination and creativity.

This is the first attempt to study whether there any educational benefits in exposing children to magical content like witches and wizards, Santa Claus, the Easter bunny and the tooth fairy.

Watching Harry Potter films could make young children more creative, say researchers at Lancaster University in the UK.

The study examined if there was a link between magical thinking and creativity in preschool children ? and it found that there was.

The small-scale study involved 52 four to six-year-old children. The youngsters were split into two groups and shown two 15-minute clips from Harry Potter And The Philosopher's Stone.

The findings show that after watching the clips, the group who watched the magical scenes in general scored "significantly better" in all three areas than their peers in the other group who watches scenes without any magical content.

Researchers Dr Eugene Subbotsky, Claire Hysted and Nicola Jones from the Department of Psychology at Lancaster University concluded that: ?Magical thinking enables children to create fantastic imaginary worlds, and in this way enhances children?s capacity to view the world and act upon it from multiple perspectives. The results suggested that books and videos about magic might serve to expand children?s imagination and help them to think more creatively.?

Magical thinking involves believing in supernatural events like animals speaking human languages, or a witch flying on a broomstick. This involves the ability to construct an alternative world and research has shown that most 4 to 6 year olds think magically in everyday life.

Some of the scenes includes animals talking and witches and wizards performing spells and using wands, while other scenes featured the same characters but without any magical content.

The children were then tested for creativity which included being asked to pretend they were a rabbit or driving a car. They were also asked to think of different ways of putting plastic cups in a bin and for alternative uses for the cup.????

The children who had watched the magical scenes performed significantly better on the creativity tests.

The researchers concluded that rather than just being used for entertainment, ?magical thinking can be viewed as an additional source of development of imagination and divergent thinking in children.?

Interesting.? And you protect all three at the Office?

KAPPOS:
We don?t actually.? Although all intellectual property is protected by the Constitution, Congress has determined that our office only handles patents and trademarks.? Copyrights are registered through the U.S. Copyright Office.

MAHAJAN:
I see.? Now, Deputy Director, how do you get a patent or a trademark registration?? Do you just fill out a form, pay a fee, and you?re all set?

REA:
Well, sometimes applicants wish that it was that easy, but the process is actually a bit more complex.

MAHAJAN:
How so?

REA:
Well, the law requires that patent and trademark applications must be examined before they can be approved.? On the patent side, for example, an invention must be new, useful, and non-obvious.? So, our examiners take the time to make sure each application meets that test.

MAHAJAN:
And what about on the trademark side?

REA:
On the trademark side, the examining attorneys make sure the mark complies with all of the legal requirements for registration of a trademark: for example, that the mark isn?t descriptive, generic, or likely to cause confusion with any other registered marks.

MAHAJAN:
Sounds like that can take some time.

REA:
It does, but the examination process is critical to fostering innovation and competitiveness in the marketplace.

KAPPOS:
Which is part of our mission.? We are dedicated to providing timely and high quality examination of patent and trademark applications.? So, not only do we grant patents and register trademarks, but our examination process gives a layer of protection to those trademarks and patented inventions that are already on the books.

REA:
All while providing the best customer service possible.

KAPPOS:
Well, exactly.? You might not always get your patent or register your trademark, but our goal is make sure the process is conducted in a courteous and professional manner from beginning to end.

MAHAJAN:
So, no guarantees, huh?

KAPPOS:
Nope.? Sorry!

REA:
But, if I could, I think this is an important point.? Applying for a patent or a trademark is, actually, a legal proceeding.? So, it?s understandable that the process can take some time to resolve itself.

KAPPOS:
Very true.? And I should also point out that we take that process, and our applicants? experience with it, very seriously.? We are constantly working to make the process more efficient and user-friendly so that our applicants can get back to doing what they do best: which is inventing, innovating, and driving our country forward.

MAHAJAN:
Well, I know our viewers will be happy to hear it.

REA:
It?s a top priority!

So, to that end, and to help us delve a little deeper into what a trademark is and why you would want to protect one, we turn now to this report, filed by our Senior News Analyst, Grant Gainsworth.

GRANT GAINSWORTH: TMIN SENIOR NEWS ANALYST:
Ancient stone seals.? Ceramic pots.? Clay bricks.? Crumbling now, but still forming the solid foundation of modern trademark law.

From the time that humans began to roam the Earth, people have used marks to indicate the maker or producer of goods.? Egyptians, Greeks, and Romans, for example, all used marks to indicate who made particular bricks and ceramics.? And, in the case of the Romans, who was to blame should the brickwork fail?

Though the uses of trademarks, and their complexity and design, have evolved, the central meaning of trademarks has remained the same: trademarks indicate source.

What does that mean?? Well, to answer that, let?s take a look at what a trademark is.? Essentially, a trademark is any word, letter, number, design, or combination of those, that identifies one party as the source of particular goods and services.

Makes sense, right?? When you see a logo on a digital camera, or a bunch of bananas, or a pair of jeans, you know who made or produced those goods.? You use the logo to distinguish the goods you want from the goods made or produced by a competing brand.

Which explains why trademarks are so important.? Over time, trademarks gain reputations.? Sometimes good; sometimes bad.? But consumers come to expect a certain level of quality based upon that reputation, which then drives their purchasing decisions.

So the question then becomes: ?How do I get a trademark?? and ?How do I protect it??? For answers, I sat down with the USPTO Commissioner for Trademarks.

So, Commissioner, how do you get a trademark?

DEBBIE COHN, COMMISSIONER FOR TRADEMARKS:
That?s a great question, Grant, and it brings up a fairly common misconception.? There?s a difference between using or ?getting? a trademark and owning a federal registration for that trademark.

GAINSWORTH:
And what?s that?

COHN:
Well, anytime you use a word, a letter, a number, a design, or a combination of those, to indicate the source of goods or services, that?s a trademark or service mark.? In legal parlance, we call that a ?common law? mark.? You see a ?TM? or an ?SM? next to a mark sometimes, indicating that the company considers that to be their trademark or service mark, but hasn?t yet federally registered it.

GAINSWORTH:
OK?

COHN:
That?s in contrast with federally registering a trademark, which means that, not only are you using the mark in interstate commerce, but you have federally registered it with the USPTO and can use the ?R in the circle? symbol after the mark.

GAINSWORTH:
So you?re saying that a person can have and use a trademark without registering it with the USPTO.

COHN:
That?s right.? There?s no requirement that you register your mark with us, or with your state, but you miss out on powerful rights and significant protection for your mark.

GAINSWORTH:
What types of rights and protection are you talking about?

COHN:
Well, there are a whole host of them.? Perhaps the greatest asset, however, is nationwide protection.? Getting a federal registration means you put the public on notice, throughout the country and U.S. territories, that you have exclusive rights to use that mark.? In addition, getting a federal registration creates a legal presumption that you have that exclusive right.? And, should you encounter unauthorized use of your mark by another party, you can sue that party in federal court.? Those are pretty powerful tools.? Plus, you can use your registration as a basis for registering your mark in a foreign country and to stop infringing goods from entering this country.

GAINSWORTH:
Not to mention using the ?R in the circle? symbol, right?

COHN:
That?s right.

GAINSWORTH:
Now, does the USPTO enforce and defend trademark rights?

COHN:
We don?t, actually; that duty belongs to the individual trademark owner.? But registration does provide a sort-of ?automatic? layer of protection: if you have a live federal registration and someone else tries to register a confusingly similar mark on related goods or services, their mark should be refused registration.? It?s all part of the thorough examination process the Office performs on every application.? So, while we don?t ?defend? your mark, per se, the registration process itself does provide a basic level of protection.

GAINSWORTH:
