Lawyer: Case will never end for Jackson kids

A prosecutor told jurors Thursday that Michael Jackson's doctor is responsible for his death and for leaving his children without a father.

Deputy District Attorney David Walgren invoked Jackson's children early in his closing argument, saying the superstar had them in mind in his final days and they were a driving force behind his planned series of comeback concerts.

"For Michael's children, this case will go on forever because they do not have a father," Walgren said. "They do not have a father because of the actions of Conrad Murray."

Walgren also recounted for jurors how Jackson's daughter Paris came upon Murray frantically trying to revive her lifeless father and screaming, "Daddy!"

The prosecutor urged jurors to convict Murray of involuntary manslaughter in Jackson's death on June 25, 2009. He repeatedly called Murray's treatment of Jackson "bizarre" and said there was no precedent for the cardiologist giving the singer a powerful anesthetic as a sleep aid.

"Ladies and gentlemen, the evidence in this case is overwhelming," the prosecutor said after thanking the panel for its attentiveness throughout the case.

"Michael Jackson trusted Conrad Murray," he said. "He trusted him with his life."

Murray silently watched slides shown by the prosecutor during his presentation. He has pleaded not guilty and his attorneys will lay out his version of events after the prosecutor finishes his argument.

Throughout the trial, Walgren cast Murray as an inept, reckless physician who was distracted after giving the singer a powerful dose of the anesthetic propofol as a sleep aid.

Walgren noted that Murray did not call emergency services after finding Jackson unresponsive. Instead he called Jackson's personal assistant, a decision the prosecutor said was just one of the doctor's bizarre actions on the day the singer died.

"He knew his acts killed Michael Jackson," Walgren said. "Maybe he's panicked. Maybe he's cleaning up ... But he's putting Conrad Murray first. He's intentionally not calling 911. He's intentionally delaying help that could have saved Michael Jackson's life."

The prosecutor also pointed out that Murray's own phone records contradict his statement to police that Jackson was complaining about not being able to sleep in the hours before the doctor said he gave him propofol.

Murray was on the phone when the supposed complaints from Jackson were being made, Walgren said.

"What was so pressing that he just couldn't care for Michael Jackson?" Walgren asked without giving jurors an answer.

The prosecutor also reminded jurors that Murray never mentioned to paramedics or emergency room doctors that he had been giving Jackson propofol for roughly two months before his death.

"That is consciousness of guilt," Walgren said. "That is Conrad Murray knowing full well what caused Michael Jackson's death."

Walgren told jurors that Murray ordered more than four gallons of propofol and had it shipped to his girlfriend's Los Angeles-area apartment.

Prosecutors say Murray was engaged in a lawful practice by giving propofol to Jackson but acted in a criminally negligent way by using the drug as an insomnia treatment without the presence of proper staff or medical equipment.

They also contend Murray botched resuscitation efforts, kept no medical records and lied to other medical personnel about his actions.

The majority of the witnesses and evidence was presented by prosecutors, who must convince the entire jury beyond a reasonable doubt in order to convict Murray.

Walgren also referred to a recording of Jackson found on Murray's cellphone in which the singer's speech was slow and slurred. The prosecutor said it was not known why Murray made the recording but that it was made "by a doctor who will not keep a shred of medical records."

Lead defense attorney Ed Chernoff is likely to argue later in the day that Jackson was responsible for his own death and took a fatal dose of propofol when Murray left his bedroom.

Walgren attacked the theory and the expert ? retired anesthesiologist Dr. Paul White ? who presented it to jurors.

"What you were presented by Dr. White was junk science," Walgren told jurors. "It was garbage."

The prosecutor noted that some of the charts White presented to jurors were prepared by a researcher the night before he took the stand. The researcher didn't testify and had been watching the proceedings on TV, Walgren said.

Earlier in the day, Superior Court Judge Michael Pastor gave jurors instructions considering the evidence in the case and reminded them before Walgren began speaking that closing arguments are not evidence.

The seven-man, five-woman jury has listened attentively throughout the six-week trial that featured 49 witnesses and complex medical testimony. They also heard several audio recordings, including Murray's lengthy interview with police detectives.

The jury did not hear directly from Murray, who opted not to testify in his own defense.

The doctor could faces up to four years behind bars and the loss of his medical license if he's convicted.

Feds: Men got terror ideas from underground novel (AP)

GAINESVILLE, Ga. ? In the violent underground novel "Absolved," right-wing militia members upset about gun control make war against the U.S. government. This week, federal prosecutors accused four elderly Georgia men of plotting to use the book as a script for a real-life wave of terror and assassination involving explosives and the highly lethal poison ricin.

The four suspected militia members allegedly boasted of a "bucket list" of government officials who needed to be "taken out"; talked about scattering ricin from a plane or a car speeding down a highway past major U.S. cities; and scouted IRS and ATF offices, with one man saying, "We'd have to blow the whole building like Timothy McVeigh."

Federal investigators said they had them under surveillance for at least seven months, infiltrating their meetings at a Waffle House, homes and other places, before finally arresting them Tuesday, just days after discovering evidence they were trying to extract ricin from castor beans.

"While many are focused on the threat posed by international violent extremists, this case demonstrates that we must also remain vigilant in protecting our country from citizens within our own borders who threaten our safety and security," said U.S. Attorney Sally Quillian Yates.

The four gray-haired men ? Frederick Thomas, 73; Dan Roberts, 67; Ray Adams, 65; and Samuel Crump, 68 ? appeared in federal court Wednesday without entering a plea and were jailed for a bail hearing next week. They apparently had trouble hearing the judge, some of them cupping their ears.

Thomas and Roberts were charged with conspiring to buy an explosive device and an illegal silencer. Prosecutors would not say whether the men actually obtained the items. Adams and Crump were charged with conspiring to make a biological toxin.

Relatives of two of the men said the charges were baseless. The public defender assigned to the case had no comment.

Prosecutors said that Thomas was the ringleader and that he talked of carrying out the sort of actions described in "Absolved," an online novel written by former Alabama militia leader Mike Vanderboegh. In the book, the militia members build rifle grenades and drop explosives from crop dusters.

In the book's introduction, Vanderboegh calls it a "cautionary tale for the out-of-control gun cops of the ATF."

"For that warning to be credible, I must also present what amounts to a combination field manual, technical manual and call to arms for my beloved gunnies of the armed citizenry," he writes. "They need to know how powerful they could truly be if they were pushed into a corner."

In an interview, Vanderboegh said he didn't know the four men and bears no responsibility for the alleged plot.

"I'm glad that the FBI has apparently short-circuited some weak-minded individuals from misinterpreting my novel," he said.

Last year, Vanderboegh was denounced for calling on citizens to throw bricks through the windows of local Democratic headquarters across the country to protest President Barack Obama's health care plan. Several such incidents occurred. Vanderboegh has also appeared as a commentator on Fox News Channel.

Vanderboegh wrote on his blog Wednesday that his book was fiction and that he was skeptical a "pretty geriatric" militia could carry out the attacks the men were accused of planning.

But Kent Alexander, a former U.S. attorney in Atlanta, said he wouldn't write off the men as harmless just because of their age: "Crime doesn't have a retirement age. These guys are older than one usually sees, but criminals come in all ages."

Donnie Dixon, another former U.S. attorney, said: "I would find it extremely difficult to think they could carry out a plot of such grandiose design, which doesn't mean they should not have been nipped in the bud just like they were." He said it would not have required anything grandiose "to cause a lot of problems or hurt a lot of people."

Thomas' wife, Charlotte, told The Associated Press the charges were "baloney."

"He spent 30 years in the U.S. Navy. He would not do anything against his country," she said. "He loves his country."

Roberts' wife, Margaret, said her husband retired from the sign business and lives on a pension. "He's never been in trouble with the law. He's not anti-government," she said. "He would never hurt anybody."

Ricin is a castor-bean extract whose potential as a deadly biological weapon has long been known. In 1978, Bulgarian defector Georgi Markov was assassinated in London with a ricin pellet believed to have been fired from the tip of an umbrella.

Prosecutors wouldn't comment outside court Wednesday on exactly what steps the men took to get their hands on ricin. But they pointed out in court records that the two men allegedly assigned to obtain or make the ricin had useful backgrounds: Adams used to be a lab technician for a U.S. Department of Agriculture agency, and Crump once worked for a contractor who did maintenance at the Atlanta-based Centers for Disease Control and Prevention.

Also, Roberts claimed to know a former U.S. soldier who was a "loose cannon" and might be able to help them make ricin, according to court papers.

An informant saw lab equipment and a glass beaker at Adams' home in October, and a bean obtained by the informant tested positive for ricin, prosecutors said.

Thomas is also accused of driving to Atlanta with an informant to case buildings that house the Bureau of Alcohol, Tobacco and Firearms, the IRS and other agencies. During the trip, Thomas allegedly said: "There's two schools of thought on this: Go for the feds or go for the locals. And I'm inclined to consider both. We'd have to blow the whole building like Timothy McVeigh."

Thomas also allegedly boasted of making a "bucket list" of government employees, politicians, businessmen and media members. Court records quoted him as saying: "There is no way for us, as militiamen, to save this country, to save Georgia, without doing something that's highly, highly illegal: Murder."

He also allegedly told an informant: "I could shoot ATF and IRS all day long. All the judges and the DOJ (Department of Justice) and the attorneys and prosecutors."

Court documents accused Crump of suggesting ricin could be dropped from the air or blown out of a car to attack people in Washington; Newark, N.J.; Jacksonville, Fla.; Atlanta and New Orleans.

WWE.com has heard rumors that Kevin Nash has been re-signed to a WWE contract by EVP of Talent Relations and Interim Raw General Manager John Laurinaitis. Sources say that Laurinaitis has re-signed the former WWE Champion at the request of WWE COO Triple H.

The Game and Nash have a long and storied history that stems back to their days as Kliq cohorts, alongside WWE Hall of Famer Shawn Michaels. More than a decade after their friendship first rocked WWE behind the scenes, Nash returned earlier this year and was fired by The Game. The near 7-footer attacked Triple H at Night of Champions and Vengeance, then last week on Raw SuperShow, The Cerebral Assassin called out Nash and asked Laurinaitis to re-sign him so he could confront him, face-to-face. Nash shocked Triple H and the WWE Universe when he emerged to attack The Game with a sledgehammer twice, forcing the WWE COO to be rushed to a medical facility where he was identified as suffering severe neck injuries.

If he's re-signed, the 7-foot Nash will undoubtedly be ready to make his presence known. If the former best friend of The Game is re-signed, how will this impact Raw SuperShow? With Triple H injured, will Nash have a different target? Triple H said he wanted Laurinaitis to give Nash an offer he couldn't refuse. Just how much could Nash's contract cost WWE?

Look out! The Muppets get 'Raw'

Over-the-top action is the only kind of action on ?WWE Monday Night Raw,? but for the Halloween episode, the wrestling staple went beyond the expected costumed crusaders and masked baddies. The Muppets took over the show.

The first Muppet-wrestler showdown took place shortly after the opening, when Kermit and his gal pal Miss Piggy clashed with "Raw" regulars Jack Swagger and Vickie Guerrero. It seems everyone?s favorite frog mistakenly referred to Guerrero as Swagger?s mother rather than manager. Talk about fighting words. ?In fairness to Kermie, Guerrero called the Muppets "livestock" first.

From there, things really ramped up, as WWE star Kelly Kelly locked lips with Kermit -- to Piggy?s horror. Big mistake.

Muppet fans can catch more from the felt friends when their latest movie, ?The Muppets,? hits theaters Nov. 23.

Microsoft's Windows 8 developer preview greeted us with an interface steeped in Redmond's new Metro style -- its tile-centric start screen is sleek, fresh, and downright pretty. Imagine our surprise then, when the preview's desktop default view punted us straight back to the contemporary "Aero" dressing of Windows 7. It's not an ugly interface by any means, but shiny, translucent window frames are so last generation. Where's the style? In the big M's latest Building Windows 8 preview, of course. The MSDN blog's latest Task Manager update shows the familiar feature in a clean Metro suit. Although Aero is still the OS' default look, the Windows 7 basic theme has been substituted for a style heavily inspired by Metro's clean tiles. The post doesn't say much on the matter (nothing at all, in fact), but it's nice to see the classic interface getting a facelift to match Microsoft's new look. Want to see more? Barclays will be cut to 54 holes

EDISON, New Jersey - The PGA Tour on Friday reduced its first playoff event to 54 holes because of the rain and potential damage expected from Hurricane Irene.

New Jersey was under a hurricane warning, and officials feared up to 10 inches of rain could fall on Sunday. That would make it impossible for The Barclays to be a 72-hole tournament, and the aftermath of the storm would keep Plainfield Country Club from being ready even into early next week.

Tournament director Peter Mele also said the volunteers needed to be home to make plans for their families.

"It kind of makes you want to cry because of all the effort that went in, and all of the energy that surrounded this event going into the week, which is going to be the best Barclays we have ever had," Mele said.

Slugger White, the tour's vice president of competition, said the plan was finish 36 holes Friday and start the third round first thing Saturday morning, with hopes of getting in a 54-hole event before the rain arrives.

If they can't finish Saturday, he said it would revert to a 36-hole tournament. Points would be distributed as if it were a full event, meaning the top 100 players after The Barclays would advance to the second playoff event next week outside Boston.

Left unclear was whether a 36-hole tournament ? if that were the case ? would count as an official win. Six years ago, Adam Scott won the Nissan Open at Riviera in a playoff after rain reduced the tournament to 36 holes. Scott was awarded the prize money, but it did not count toward the money list, and he received only 75 percent of the world ranking points.

"In the past it has not been an official win," White said. "But this is a little different situation."

What mattered more at this FedEx Cup playoff event was advancing to Boston. A short tournament figured to work in the favor of someone like Padraig Harrington and Will McGirt, the last two players of the 125 who qualified for the playoffs. They were off to a good start at The Barclays, and had only one more round to go to get into the top 100.

And it suddenly became compelling at the top of the leaderboard.

Matt Kuchar shot a 65 in the second round Friday morning. He was one shot ahead of Dustin Johnson, who was playing the reachable 18th hole. Justin Rose also finished his second round at 65 and was alone in third place.

It was another blow to The Barclays, one of golf's biggest sponsors which is enduring a wet streak. It's Singapore Open last fall did not finish until Monday because of rain. Another event it sponsors, the Scottish Open, was reduced to 54 holes in July because of rain.

White said workers would start taking down the electronic scoreboards Friday afternoon.

The Barclays was a sellout at Plainfield. Mele said only Saturday tickets would be honored for the third round. He said those who had Sunday tickets would be able to use them next year, when the tournament moves to Bethpage Black.

This is the second straight year a hurricane has been the focus at a playoff event. Hurricane Earl threatened the Deutsche Bank Championship outside Boston last season, although it never developed.

"I think you never know with hurricanes. They are fickle as we all know," Mele said. "Unfortunately, this one wasn't."
